1. ACCEPTANCE OF TERMS

By accessing or using BookMyClinic ("BMC", "we", "our", or "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. DESCRIPTION OF SERVICE

2.1 What We Do

BookMyClinic is an online appointment booking platform that connects patients with independent healthcare clinics and practitioners in Gujarat, India. We provide a technology platform for appointment scheduling only.

2.2 What We Don't Do

• We do NOT provide medical services, treatment, or healthcare
• We do NOT employ or supervise the doctors/clinics listed on our Platform
• We do NOT verify medical qualifications or licenses (doctors self-declare credentials)
• We do NOT guarantee treatment outcomes or quality of care
• We are NOT a healthcare provider or medical institution

2.3 Our Role

We are an "Intermediary" as defined under Section 79 of the Information Technology Act, 2000. We act as a facilitator connecting patients with clinics and are not responsible for the medical services provided by listed clinics.

3. ELIGIBILITY

You must be at least 18 years old to use our Platform. By using BMC, you represent that you meet this age requirement.

4. FOR PATIENTS

4.1 Booking Appointments

• You can search for clinics and book appointments through our Platform
• Appointments are subject to clinic availability and confirmation
• We do not charge any fees for booking appointments (service is free)

4.2 Your Responsibilities

• Provide accurate contact information (name and mobile number)
• Arrive on time for scheduled appointments
• Cancel appointments if unable to attend
• Verify clinic credentials independently before receiving treatment
• Follow clinic policies regarding payments, cancellations, and medical procedures

4.3 Clinic Information

All clinic information (name, address, timings, doctor details, registration numbers) is provided by the clinics themselves. BMC displays this information in good faith but does NOT independently verify:

• Medical degrees or qualifications
• Medical council registration numbers
• Clinic licenses or permits
• Years of experience claims

We recommend patients verify doctor credentials at respective Medical Council websites before treatment.

4.4 Registration Numbers

Registration numbers displayed on clinic profiles are self-declared by doctors. Patients can verify these at relevant Medical Council websites.

4.5 No Medical Advice

• BMC does not provide medical advice, diagnosis, or treatment recommendations
• Information on our Platform is for appointment booking purposes only
• Always consult qualified healthcare professionals for medical decisions

5. FOR CLINICS/DOCTORS

5.1 Registration Requirements

To list your clinic on BMC, you must:

• Provide accurate clinic information (name, address, contact details, timings)
• Provide accurate doctor information (name, qualification, registration number)
• Have a valid medical license/registration to practice in India
• Comply with all applicable healthcare regulations and laws

5.2 Your Warranties and Representations

By registering on BMC, you warrant and represent that:

• You hold valid medical licenses and registrations required to practice medicine/healthcare in India
• All information provided (qualifications, registration numbers, experience) is accurate and truthful
• Your clinic complies with the Clinical Establishment Act and other applicable regulations
• You are authorized to accept appointments and provide medical services
• You will honor appointments booked through BMC

5.3 Your Responsibilities

• Maintain accurate and up-to-date information on your profile
• Honor appointments booked through BMC platform
• Provide the same quality of care to BMC patients as walk-in patients
• Do NOT charge extra fees to patients who book via BMC
• Comply with all medical ethics and professional standards
• Protect patient data in accordance with applicable privacy laws
• Display BMC QR poster at your reception (for Founding Partner clinics)

6. PRIVACY AND DATA PROTECTION

We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act) and Information Technology Act, 2000. See our Privacy Policy for complete details on how we collect, use, and protect your data.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

7.1 No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

7.2 Medical Disclaimer

BMC IS NOT A HEALTHCARE PROVIDER. We do not diagnose, treat, or cure any medical conditions. We do not recommend or endorse any doctors or clinics. We do not guarantee treatment outcomes. We do not verify medical credentials.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BMC SHALL NOT BE LIABLE FOR:

• Medical malpractice or treatment errors by listed clinics/doctors
• Damages arising from treatment received at listed clinics
• Disputes between patients and clinics
• Incorrect or outdated clinic information
• Appointment cancellations or no-shows

MAXIMUM LIABILITY: Since BMC is a free service for patients, our maximum liability to patients is ₹0 (zero rupees).

8. COMPLAINTS AND DISPUTE RESOLUTION

8.1 Complaint Mechanism

If you encounter any issues:

8.2 Report Fake/Fraudulent Clinics

Patients can report suspicious clinics using "Report this clinic" button on clinic profiles. We will investigate and take appropriate action.

9. TERMINATION

We reserve the right to suspend or terminate accounts for violation of these Terms, fraudulent activities, or providing false information.

10. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use constitutes acceptance of modified Terms.

11. GOVERNING LAW

These Terms shall be governed by the laws of India. Courts in Ankleshwar, Gujarat shall have exclusive jurisdiction.

• BMC is an intermediary platform, not a healthcare provider
• Clinics are independent entities responsible for medical services
• Doctor credentials displayed are self-declared and not verified by BMC
• You agree to verify clinic credentials independently before receiving treatment
